Wholesale Terms

The terms for buying plants, trays, bare root, lavender products and custom-label goods at wholesale from Great Lakes Lavender Farm.

Every wholesale order

Order accuracy and authority

I reviewed the business, product, variant, quantity, price, fulfillment, and requested-date details shown in this agreement. I am authorized to place this order and bind the purchasing business. I will promptly report any mismatch before checkout.

Requested dates are scheduling requests

Requested ship or pickup dates are not guaranteed delivery dates. Crop readiness, weather, carrier conditions, regulation, inspection, and events outside the farm’s reasonable control may require a hold or revised date. Great Lakes Lavender Farm will communicate a material change and obtain buyer approval before a material cultivar substitution or materially different date; it will not silently substitute a cultivar. If crop loss or the farm’s inability to supply makes an item unavailable and no approved alternative is accepted, the farm will refund the unavailable goods as the agreement and applicable law require.

No consultation is included

The price includes the goods, ordinary order communication, and the identified written care materials. It does not include site or cultivar selection, planting design, soil diagnosis, business planning, ongoing coaching, or phone, text, video, on-site, legal, regulatory, or individualized growing consultation unless separately purchased in writing. I remain responsible for those decisions. Nothing in this block limits an express product promise or a right that applicable law does not allow the parties to waive.

Business-purpose transaction and Michigan law

I am making this wholesale purchase primarily for business or resale purposes. Michigan law governs this agreement without eliminating any nonwaivable right or any mandatory law that applies to the transaction or destination. The parties may preserve evidence and seek commercially reasonable resolution of a dispute.

Electronic signature and records

I consent to use electronic records, initials, my signer name, and my adopted handwritten electronic signature for this transaction. I can print or save the completed agreement. The signed agreement, its audit hash, and later order-association checks may be retained for the purchaser’s and farm’s records, subject to applicable privacy law.

Live plants: payment, seasons and pickup

Production deposit and remaining balance

Where the order uses Great Lakes Deposits, the 50% production deposit reserves greenhouse space, crop allocation, and production labor for this order and covers the lost selling season created by cancellation. The deposit is non-refundable after acceptance. If a live-plant line was paid in full because its requested date was within 30 days and I cancel before fulfillment, the farm keeps 50% of that line and refunds the rest. Great Lakes Lavender Farm will refund everything paid for an item, deposit included, when it cannot propagate or supply that item because of crop loss or its own inability to supply. The remaining balance is due 14 days before the requested ship or pickup date; an approved date change moves that due date. Nothing here limits a refund that applicable law requires.

Live-plant shipping seasons and restrictions

Live-plant shipping normally operates March 1–May 31 and October 1–November 30, with an unprotected winter requested-date option where offered. June 1–September 30 is local pickup only because of summer heat and the farm’s current Japanese Beetle compliance process, unless a lawful product-specific pathway is expressly available. Plugs and potted plants do not use our shipping path to AZ, CA, HI, ID, NV, OR, UT, or WA. Bare-root plants are always soil-free and may ship to those states during the March 1–May 31 bare-root window without a separate approval. Shipped wholesale plant orders include the per-tray or per-box handling charge shown with the order (currently $5 per 20-cell or 72-cell tray or per 25-plant bare-root box), plus carrier cost; local pickup has no handling charge. Destination restrictions and agency directions control over a requested date.

Temperature review and weather-dependent coverage

For shipped live plants, 33–39°F triggers a cold advisory and 80–90°F triggers a heat advisory. At 32°F or below, or above 90°F, an otherwise lawful order may continue, but the displayed weather-dependent coverage programs are unavailable for that shipment. No weather acknowledgment is required. Seasonal, destination, agricultural, inspection, lot, and plant-health restrictions still control, and applicable nonwaivable rights are not limited.

Protection and warranty are separate

This agreement records the server-confirmed coverage decision for this exact order. 24-Hour Healthy Arrival is included only when the recorded decision says INCLUDED. Shipping Protection and the 1-Year Grow Guarantee require a valid server quote and exact order reconciliation.

Live-plant inspection and care

Live plants are variable agricultural goods. I will confirm the cultivar, zone suitability, site, drainage, light, watering, acclimation, and planting plan before ordering; inspect plants promptly on receipt or pickup; follow the written care guide; and preserve clear photos, packaging, and order information for any timely claim. Neglect, unsuitable conditions, delayed planting, winter injury, or care contrary to the guide is not a farm-caused defect.

Local pickup appointment

Local pickup is by an available Wednesday or Friday appointment, normally 10:00 a.m.–3:00 p.m. Eastern Time. I will not arrive until the farm confirms that the order is ready. I am responsible for a vehicle, loading plan, temperature control, and safe transport appropriate to the order.

Orders not picked up within 14 days

The 14-day period begins when Great Lakes Lavender Farm tenders readiness in a written ready-for-pickup notice. If I do not pick up within 14 calendar days and do not obtain a written extension, the farm will send a final notice before any commercially reasonable reallocation, resale, or—when necessary for perishable goods—disposal. The farm may account for resale proceeds and lawful documented crop allocation, care, handling, and damages; it will not silently treat all money as forfeited. A later replacement or pickup date is not guaranteed.

Plant formats

72-cell wholesale trays

A listed 72-cell item is sold as one complete tray of 72 rooted plants in the farm’s applicable deep-cell tray format. Quantity 1 means one complete tray. The wholesale minimum is two qualifying 72-cell trays total, and qualifying varieties may be mixed to reach that minimum. Cell development and top growth naturally vary. I will count and inspect promptly, acclimate plugs, prevent saturated media, and transplant on a schedule suitable for my conditions.

20-cell wholesale trays

A listed 20-cell item is sold as one complete tray of 20 rooted plants in the farm’s applicable deep-cell tray format. Quantity 1 means one complete tray. The wholesale minimum is three qualifying 20-cell trays total, and qualifying varieties may be mixed to reach that minimum. Cell development and top growth naturally vary. I will count and inspect promptly, acclimate plugs, prevent saturated media, and transplant on a schedule suitable for my conditions.

Bare-root plants

Bare-root plants are seasonal live plants offered for the March 1–May 31 window, sold in boxes of 25 per variety (multiples of 25). I will open and inspect them promptly, keep roots protected from drying, freezing, and heat, and heel in or plant them without avoidable delay. Natural dormancy or lack of top growth at receipt is not by itself proof of death.

Potted and rooted-plug plants

Container and rooted-plug sizes describe the listed production format, not a promise of identical height, bloom, branching, or root shape. I will inspect promptly, acclimate plants, avoid saturated media and buried crowns, and transplant or maintain them according to their container size, season, and my conditions.

Patented and protected cultivars

A patent, patent-pending, plant-breeders’-rights, trademark, or license notice remains in force after resale. Unless the rights holder gives separate written permission, I will not asexually propagate a protected cultivar and will preserve required cultivar, patent, and trademark labeling. Buying plants does not transfer propagation or intellectual-property rights.

Merchandise, custom label and resale

Resale, labeling, and regulatory responsibility

As the wholesale buyer, I am responsible for resale permits, nursery or dealer licensing, inspections, destination rules, taxes, truthful labels and claims, and all laws that apply after transfer. I will preserve cultivar identity and will not represent Great Lakes Lavender Farm’s general materials as a site-specific guarantee or professional consultation.

Custom labels and buyer-supplied content

I am responsible for the accuracy, legality, and rights to any buyer-supplied logo, label copy, claims, barcode, or artwork. Production begins only from the approved proof or specification. Color, material, and placement can vary within ordinary production tolerances. Custom and private-label goods are payable in full before production and cannot be treated as freely cancellable after work begins.

Finished wholesale retail goods and approved trade credit

Finished retail goods are purchased for resale in the listed case packs and are not live-plant production reservations. The first three qualifying completed direct wholesale-retail purchases are payable in full. After three qualifying purchases, Great Lakes Lavender Farm may make Net-30 available to the purchasing business for eligible finished wholesale-retail goods. Net-30 never applies to live plants, production deposits, preorders, custom/private-label goods, or protection-only or mixed carts, and it may be reduced or suspended after a late, failed, disputed, or refunded payment.

Non-plant wholesale goods

Non-plant wholesale items are payable in full unless the order expressly displays a different approved schedule. I reviewed pack size, materials, customization, and lead time. Care, weather, live-arrival, and plant-warranty programs do not apply to non-plant goods.
