Overview

Welcome to Great Lakes Lavender Farm

“We,” “us” and “our” mean Great Lakes Lavender Farm. We operate this store and website, including its information, content, features, tools, products and services (the “Services”). Our online store is powered by Shopify.

These Terms of Service, together with the policies and program terms they reference (the “Terms”), describe your rights and responsibilities when using the Services. They include important information about purchases, warranties, intellectual property and limits of liability.

Access & Accounts

You represent that you’re at least the age of majority where you live, or that you have authority to let minor dependents use the Services on devices you own or manage. Information you provide must be accurate, current and complete.

You’re responsible for your account credentials and activity, and you may not sell, transfer, assign or license your account without our consent.

Our Products

We make reasonable efforts to describe products accurately. Color, size and appearance can vary with screens, photography, lighting and natural variation.

Descriptions, specifications, availability and prices may change, and we may discontinue products or reasonably limit quantities. Nothing here removes an express guarantee or protection provided with or purchased for an eligible product.

Orders

Submitting an order is an offer to purchase. We may accept, decline, limit or cancel an order when reasonably necessary — for example because of availability, payment concerns, suspected fraud, listing errors, shipping restrictions, weather risk to plants or other legitimate business reasons. An order is accepted once payment is processed and the order is accepted for fulfillment.

Retail & wholesale purchases

Products may be bought for personal, household, horticultural, agricultural or commercial use where permitted. Wholesale buyers don’t need prior approval to place and pay for a wholesale order. You review and accept our Wholesale Terms in the Review Basket before checkout; there’s no separate contract to sign. Wholesale pricing is for businesses: we review wholesale orders and may cancel and refund an order if the buyer doesn’t qualify. Tray, plug, bare root and other volume purchases may also have written terms shown before purchase, which control where they conflict with these general Terms.

Custom-label products

Custom-label products are available for retail (such as weddings and events) and wholesale (such as brands and markets). You design your own labels and are responsible for having the rights to the names, artwork and text you provide. We don’t offer custom design services.

Cottage food products

Cottage food items are sold under Michigan Department of Agriculture and Rural Development (MDARD) rules. They can’t be added to an online cart; they require an order form and payment in person.

Returns

Returns and refunds are covered by our Return & Refund Policy and any applicable Protection Terms.

Prices, Payment & Billing

Prices, discounts and promotions may change before an order is placed. The price that applies is generally the one shown when you submit your order, subject to correction of material errors. Taxes, shipping and other costs may be extra unless stated otherwise. Online prices may differ from farm, event, wholesale or marketplace prices.

Live-plant terms apply to retail and wholesale buyers alike. Plant deposits reserve greenhouse space and are non-refundable if you cancel; if you paid in full and cancel before fulfillment, we keep 50% of the plant price and refund the rest. If we can’t propagate or fulfill all or part of an order, we’ll let you know and refund everything you paid for the items we can’t send, deposits included. See the Cancellation Policy.

You agree to provide accurate billing information and confirm you’re authorized to use your payment method.

Shipping & Delivery

Processing and delivery estimates are estimates, not guaranteed dates, unless expressly stated. Carrier delays, weather, holidays and events outside our control can affect delivery, and live-plant shipments may be held when shipping right away would put plants at unreasonable risk. Live plants in soil can’t ship to AZ, CA, HI, ID, NV, OR, UT and WA; bare root plants can. Live plants are pickup only from June 1 to September 30, bare root ships March 1 – May 31, and winter ship dates aren’t covered by our protection programs.

Processing, carriers, tracking, weather holds and delivery are covered by our Shipping Policy. Nothing here removes remedies under the 24-Hour Healthy Arrival Guarantee, purchased Shipping Protection, applicable consumer law or another express written protection.

Living horticultural products

Live Plants & Growing Conditions

Plant health and performance after delivery depend on hardiness zone, weather, temperature, sunlight, soil, drainage, irrigation, planting method, timing, fertilization, pests and ongoing care. Our growing guides, tools and the Lavender Grower assistant are here to help, but can’t guarantee a particular outcome unless an express written guarantee says so.

Commercial quantities

For multi-plant purchases, plant remedies may be evaluated by the number of plants affected rather than the whole tray, bundle or order.

Express customer protections

Protection Programs

We offer included and optional protection with eligible purchases: the 24-Hour Healthy Arrival Guarantee, optional Shipping Protection, 30-Day Recovery Protection when assigned by our team, and the optional 1-Year Grow Guarantee. To add the Grow Guarantee to an order, you first complete the free Lavender Care Academy while signed in to your account.

These programs are governed by the Protection Terms for the covered order. Where a specific protection provision conflicts with a general disclaimer in these Terms, the specific provision controls for that issue.

Intellectual Property

The Services — including trademarks, branding, text, photos, graphics, videos, designs and product content — may be owned by Great Lakes Lavender Farm, its licensors or other rights holders and are protected by intellectual-property laws. Except where authorized, you may not reproduce, republish, distribute, modify, scrape, commercially exploit or create derivative works from protected parts of the Services. Nothing in these Terms grants permission to use our names, trademarks, logos, designs or slogans. Shopify and other third-party marks belong to their owners.

Third-Party Tools & Links

We may provide tools, apps, integrations or links from third parties that we don’t monitor or control. Their use may be governed by the provider’s own terms and privacy practices. Linking to something doesn’t mean we endorse it, and transactions directly with third parties are governed by their terms.

Our Store Is Powered by Shopify

Shopify enables us to provide the Services, but purchases are made directly with Great Lakes Lavender Farm. Shopify isn’t the seller of our products and isn’t responsible for our obligations relating to those purchases. To the extent permitted by law, you release Shopify and its affiliates from claims arising solely from transactions between you and us for which Shopify isn’t legally responsible.

Privacy

Personal information is handled under our Privacy Policy. Because our store is powered by Shopify, Shopify also processes certain information according to its privacy practices.

Reviews, Photos & Feedback

If you submit reviews, photos, ideas or other content (“Feedback”), you confirm you have the right to do so. Unless prohibited by law or separately agreed, you grant us a worldwide, non-exclusive, sublicensable, royalty-free license to use, reproduce, adapt, publish, display and distribute Feedback in operating, improving and promoting our business. Feedback must not violate others’ rights or contain knowingly false, unlawful, defamatory or malicious content, and we may moderate or remove it.

Errors & Inaccuracies

The Services may occasionally contain errors in descriptions, availability, pricing, promotions, shipping charges or transit estimates. We may correct them and, where permitted by law, modify or cancel an affected transaction. This doesn’t remove consumer remedies that can’t lawfully be excluded.

Prohibited Uses

You may use the Services only for lawful purposes. You may not:

  • Violate the law or another person’s rights
  • Infringe intellectual property
  • Harass, threaten or unlawfully harm others
  • Submit intentionally false or misleading information
  • Transmit malware or malicious code
  • Impersonate another person
  • Improperly collect personal information
  • Circumvent security or authorization measures
  • Use unauthorized scraping or automated extraction

We may restrict or end access when these Terms are materially violated.

Automated Agents

Software acting autonomously or semi-autonomously (“Agents”) must not hide or misrepresent its automated nature, must follow our technical controls, and must not get around CAPTCHAs, robot exclusions, rate limits or other controls. We may limit automated access to protect customers, infrastructure, intellectual property and security.

Suspension & Termination

We may suspend or end access where reasonably permitted, including for material violations, fraud, abuse, security risks or unlawful activity. Amounts legitimately owed remain payable. Provisions meant to survive — including intellectual property, indemnification, liability and governing law — continue where legally enforceable.

Important legal terms

Disclaimer of Warranties

Except for express warranties, guarantees or protections specifically provided by Great Lakes Lavender Farm, and to the extent permitted by law, the Services are provided “as is” and “as available.”

To the extent permitted by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, durability, title and non-infringement where they may lawfully be disclaimed. We don’t guarantee uninterrupted, secure or error-free access. Some jurisdictions restrict these limits, so parts of this section may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, Great Lakes Lavender Farm and its owners, employees, contractors, affiliates and service providers aren’t liable for indirect, incidental, special, punitive or consequential damages from use of the Services or products, including:

Plant remedies are generally limited to those under the Healthy Arrival, Recovery Protection, Grow Guarantee or other express protection terms. Nothing here prevents a replacement, refund, credit or other remedy expressly promised by a protection program, or limits rights that can’t legally be excluded.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Great Lakes Lavender Farm, Shopify and their affiliates, owners, employees, agents, contractors, licensors and service providers from third-party claims, losses and reasonable legal expenses arising from your material breach of these Terms, violation of law or infringement of another person’s rights.

Severability, Waiver & Assignment

If any provision is unenforceable, it will be enforced to the maximum extent permitted or severed as narrowly as necessary, and the rest stays in effect. Not enforcing a right right away doesn’t waive it. These Terms, with the policies and specific terms they reference, govern the Services; more specific written terms control when they expressly apply to a product, protection program, promotion or commercial transaction.

You may not assign material rights or obligations without our prior written consent where permitted by law. We may assign ours in connection with a merger, reorganization, sale or similar transfer. Headings, summaries, icons and navigation are for readability and don’t change the meaning of these Terms.

Governing Law & Venue

These Terms are governed by United States federal law and the laws of the State of Michigan, without regard to conflict-of-law principles where legally permitted. Subject to rights that can’t be waived, disputes may be brought in courts with appropriate jurisdiction in or serving the area where Great Lakes Lavender Farm is headquartered.

Changes to These Terms

The current version is always on this page. We may update these Terms as our products, Services, protection programs, technology or legal obligations change. Material changes take effect according to applicable notice requirements. Unless the law requires otherwise, a purchased protection program stays governed by the Protection Terms in effect when the covered order was placed.

Live plants naturally vary. Size, foliage, branching, bloom stage, roots, dormancy and seasonal appearance may differ from photos while the plant is still healthy and matches what you bought.

Descriptions, specifications, availability and prices may change, and we may discontinue products or reasonably limit quantities. Nothing here removes an express guarantee or protection provided with or purchased for an eligible product.

Orders

Submitting an order is an offer to purchase.
